Minutes
The Waimakariri District Council has appointed an independent hearings panel (panel) to hear an application by Rolleston Industrial Developments Limited (the applicant/application) for a private plan change (RCP 31) to the Waimakariri District Council pursuant to Part 2 Schedule 1, of the Resource Management Act 1991 (RMA).
The Minute makes directions, to:
(a) the Waimakariri District Council to file a report prepared pursuant to section 42A of the RMA.
(b) The applicant and submitters and further submitters (‘submitters/submissions’) to file expert evidence pursuant to section 41B RMA and set time limits pursuant to section 41C RMA.
The purpose of this Minute is to provide further directions to the parties in relation to the hearing of RCP 31 due to commence on 3 August 2023.
The purpose of this Minute is the Hearing Panel have identified two issues that we would be assisted further by the expert Planning and Transport witnesses meeting to produce a joint witness statement to narrow or resolve issues of contention.
The hearing of the application for RPC 31 by Rolleston Developments Limited requesting changes to the zoning of rural land in Ōhoka to enable residential and some commercial and associated facilities commenced on Thursday 3 August 2023 and continued until Thursday 10 August 2023, at which point we adjourned the hearing subject to the following further directions.
The purpose of this Minute is to provide directions for reporting back from expert conferencing, final recommendation of s42A Reports and Applicant's Right of Reply.
The purpose of the Minute is to explain that in Minute 4, amongst other matters we requested that Ms Appleyard, counsel for the applicant, to submit a memorandum to the hearing panel with possible questions for Mr Yeoman. A memorandum was filed.
We have reviewed the memorandum and agree that it would assist in our inquiry for Mr Yeoman to provide a response to those questions with some minor changes of our own. Accordingly we direct Mr Yeoman to respond with a supplementary statement to the questions set out in appendix 1 to this Minute.
The purpose of this Minute is that we have received a memorandum from counsel on behalf of the applicant requesting leave to file supplementary evidence and to resume the hearing for the presentation of the applicant’s closing legal submissions. The applicant has sought leave to file that evidence by 5 September 2023 and offered a range of dates for the hearing to reconvene.
The purpose of this Minute is to advise that we have received a memorandum from counsel on behalf of the applicant in response to Minute 6 clarifying the matters that the applicant seeks to address by way of a supplementary statement from Mr McLeod.
The purpose of this Minute is to advise that the hearing panel has read the supplementary evidence and wishes to advise that they do not require the attendance of some witnesses for questions.
The purpose of this Minute is to advise that the hearing is now closed. The Panel's report and recommendations will be issued to the Council in due course.
