Private Pools and Ponds (Swimming and Spa Pool Fencing)

Waimakariri District Council has the responsibility to administer the Fencing of Swimming Pools Act 1987. The Act was introduced to protect young children from the danger of drowning.

If you are building or installing a swimming or spa pool  you will need building consent regardless of the size or capacity of the pool. The same applies to any pond associated with a dwelling.

All pools over 400 mm in depth must be fenced, whether they are in-ground, above-ground or spa pools (with or without lockable lids).  Inflatable and temporary pools over 400 mm in depth also require fencing and building consent.  Below you will find relevant information to help you make your pool or pond comply and safe for your family and friends.

It is also your responsibility to fence your pool/pond in accordance with the Fencing of Swimming Pools Act 1987. See below for further information relating to your pool or pond.
